Terms of Use

Apple's standard license agreement applies. These terms add the details that are specific to Nightpiece.

01Agreement

Your use of Nightpiece is governed by the Apple Standard End User License Agreement (EULA). These Terms of Use add to it and apply to Nightpiece and this website. If the two ever conflict about the same point, Apple's EULA applies.

02License

Nightpiece is licensed to you, not sold. You may use it on iPhones you own or control, as the App Store rules allow. The app, its 3D artwork, designs, text and code belong to the developer; you may not copy, modify, resell or reverse engineer them except where the law says you may.

03Nightpiece Pro

Nightpiece Pro unlocks every widget, look and app icon, the meteor, ISS, full moon and eclipse alerts, the night dial of 30 days either way and the constellation lines. It is offered as:

  • Yearly: an auto-renewing subscription, with a 7-day free trial for eligible new subscribers.
  • Lifetime: a one-time purchase that does not renew.

The price, in your currency, is shown in the app before you buy and can differ by region.

04Billing and renewal

Payment is charged to your Apple ID account when you confirm the purchase, or when the free trial ends. The yearly subscription renews automatically unless you cancel it at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period. Any unused part of a free trial is forfeited when you buy a subscription.

05Managing, canceling and restoring

Manage or cancel your subscription any time in iOS Settings, under your name and then Subscriptions. Deleting the app does not cancel it. The lifetime purchase has nothing to cancel. To restore a purchase on a new device, use Restore in the Nightpiece Pro screen. Refunds are handled by Apple under its own rules.

06Sky information

Positions, phases, rise and set times, passes and eclipses are calculated for general interest and are approximations. They can be off by some minutes or degrees, and the space station's orbit changes. Do not use Nightpiece for navigation, or for any decision involving safety or property.

Never look at the Sun directly, with the naked eye, through a camera or through any optical instrument, and watch eclipses only with eye protection made for that purpose. Pay attention to your surroundings when you point your phone at the sky: do not walk, drive or stand near edges while looking at the screen.

07Acceptable use

Do not misuse the app or this website, interfere with them, or try to get around the Pro unlock. Do not use the content in a way that infringes anyone's rights.

08Third-party services

Nightpiece uses Apple services (place-name lookup, the App Store, notifications) and downloads public orbit data from CelesTrak. Their own terms apply to them. See the Privacy Policy for what is sent.

09Warranty and liability

Nightpiece is provided "as is", without warranty of any kind. To the extent the law allows, the developer is not liable for damages arising from your use of the app or website. Rights that the law gives you as a consumer are not affected.

10Changes

These terms may change. The new version will be posted here with a new version number and date. Continuing to use Nightpiece after a change means you accept it.
